Question: How long after chargeoff can a collection agency collect on a debt? Is there a statute of limitations?
Department store card was charged off in 1999, debt was sold to agency #1, who sold it to agency #2. Today I’m getting a call from Agency #3 who says there is no time limit to collecting a bad debt. I say he’s wrong.
Answer: Like the other posters said, there is a time limit where they can legally collect.
But with that being said, they can continue to call or write to you for payment unless you inform them that the account is past the legal collecting SOL (if it is) or if you request validation, especially before the first 30 days expires from their first contact.While it is illegal for them to file suit on a time barred debt, that does not stop them from filing. It would be up to you to use a SOL defense if you are past the collecting SOL when they file suit.
I would not recommend simply sending a cease and desist letter as that will not protect you in keeping them from suing you if they are planning on doing that.
You might consider sending them a SOL letter if you are past the legal collecting SOL for your state.
You should also check your credit reports to make sure they have not listed the account since it would be past the reporting period if it has been since 1999.You might click on my profile and do some reading in the links I have listed – for the FDCPA, to learn your states collecting SOL and especially the last link to find sample letter templates for a SOL letter if you are out of SOL or for validation letters if you are still within SOL.

Question: Chapter 7 Bankruptcy?
In process of filing Chapter 7 Bankruptcy – I am planning to surrender my house,car,two unsecured debts, and some medical bills. Question what will happen with my house, we can no longer afford to keep it due to basic upkeep,heating etc. The unsecured debts, I tried the route of getting help from a debt settlement company. Big mistake I found a few weeks back a notice of a court summons. So am taking the route of bankruptcy, after much thought and consideration. I am filing chap-7.
I am getting ready to go through the credit bankruptcy certification class; have a call setup Monday. Any advice tips during this would be much appreciated. Will a chap-7 get rid of these debts? Attorney says most definitely; but am scared after the credit settlement ordeal.
Answer: I went through Chapter 7 Bankruptcy almost 2 years ago. The certification classes are excellent. You will find that you’re not the only person with these problems. The credit counselors will help answer your questions and concerns. It’s normal to be scared and nervous, however, we were all in the same situation as you. Be strong and good luck.

Question: Can I obtain a passport or work visa if I’m in debt to the U.S. government?
I live in San Francisco, California and I work in the IT industry, and after recently starting a new job, my boss asked me if I could travel to Australia & China, but I explained to him that I didn’t think I could due to the law that states I must owe $0 to the government.
Anyone out there who’s knowledgeable with U.S. law know if a citizen with my circumstances can, in fact, obtain a passport or work visa for employment purposes? If so, how?

Answer: Yes, you can obtain a passport if you are in debt, in bankruptcy etc.. The only time you cannot is if you are on probation, parole, committed a felony that requires you to turn it in, or if it has been revoked for any specific reason..
